Terms of Service

1. Introduction

Welcome to Logitrack – an integrated logistics management platform combining OMS, TMS, and WMS. These Terms of Service (hereinafter referred to as “Terms”) govern the rights and obligations between Logitrack (hereinafter referred to as “We” or “Us”) and Customers/Users (hereinafter referred to as “You”).

By registering an account, using the software, or related services, You confirm that You have read, understood, and agreed to comply with these Terms in full. If You do not agree, please stop using the service.


2. Scope of Services

Logitrack software provides:

  • OMS (Order Management System): Manage, track, and process orders.

  • TMS (Transportation Management System): Manage transportation, routes, drivers, and vehicles.

  • WMS (Warehouse Management System): Manage warehouses, stock in/out, and inventory.

  • IoT & AI Integration: GPS, smart locks, RFID, surveillance cameras.

  • Data Analytics Tools: Performance reports, cost optimization, KPI measurement.

We reserve the right to add, upgrade, or change features without prior notice to improve service quality.


3. Conditions of Use

3.1 Account Registration

  • You must provide accurate, complete, and lawful information.

  • Accounts are unique and must not be shared with third parties.

  • You are responsible for keeping your username and password secure.

3.2 User Rights

  • Access and use features within the subscribed service package.

  • Receive technical support according to customer care policies.

  • Request data export upon termination of the service.

3.3 Restrictions

  • Do not use Logitrack for illegal purposes.

  • Do not interfere with, damage, or copy the software unlawfully.

  • Do not distribute malware, viruses, or conduct system attacks.


4. Copyright and Intellectual Property

  • All source code, designs, logos, content, and materials associated with the software are owned by Us.

  • You are granted a non-exclusive, non-transferable, limited license according to your service package.

  • Copying, redistribution, or commercial use without written consent is strictly prohibited.


5. Payment Policy

5.1 Service Packages

  • Free trial: 7 days (subject to change).

  • Basic / Advanced / Enterprise packages: Monthly, quarterly, or yearly fees.

  • Additional costs: If You request extra integrations, APIs, or storage.

5.2 Payment Methods

  • Payment via bank transfer, e-wallet, or online payment gateway.

  • All fees are displayed in VND (or USD for international customers).

  • Payment must be made before activation or renewal of services.

5.3 Refunds

  • No refunds once the service has been used, unless the issue is caused by Us.

  • Refunds may apply if You have not activated the service after payment.


6. Customer Obligations

  • Provide accurate and lawful information upon registration.

  • Take full responsibility for the data uploaded to the system (orders, customer info, transport documents).

  • Ensure software usage complies with Vietnamese and international law.

  • Pay fees on time and in full.


7. Provider Obligations

  • Maintain system uptime ≥ 99% (excluding maintenance or force majeure events).

  • Provide technical support via email, phone, or live chat during business hours.

  • Keep customer data confidential and not disclose to third parties, unless required by law.


8. Data Privacy Policy

  • Data is stored on secure servers with encryption and regular backups.

  • We only use data to provide services and improve user experience.

  • You may request data export or deletion at any time.

  • We may provide data to authorities if required by law.


9. Technical Support and Maintenance

  • Standard support: Business hours, Monday – Friday.

  • Advanced support: 24/7 for Enterprise packages.

  • Scheduled maintenance: Notified at least 24 hours in advance.

  • Emergency incidents: We commit to resolving issues within 2–6 hours.


10. Limitation of Liability

  • We are not liable for indirect damages, lost profits, or losses caused by Your misuse.

  • We do not guarantee the system to be completely error-free but will make best efforts to fix issues promptly.

  • In cases of force majeure (natural disasters, epidemics, fires, power/internet outages), We are exempt from liability.


11. Termination of Service

  • Customer Termination: You may stop using the service at any time, but fees already paid are non-refundable (except in special cases).

  • Provider Termination: If You commit serious violations (such as fraud, system attacks), We may suspend or delete Your account.

  • Data will be retained for 30 days after termination for backup purposes.


12. Modification of Terms

  • We reserve the right to change or update these Terms at any time.

  • The latest version will be publicly posted on the Logitrack.vn website.

  • Continued use of the service after changes means You accept the new Terms.


13. Governing Law and Dispute Resolution

  • These Terms are governed by Vietnamese law.

  • Any disputes will first be resolved through negotiation; if unsuccessful, they will be submitted to the competent People’s Court in Ho Chi Minh City.
